Confidentiality is usually mentioned among the advantages of most forms of dispute resolution, especially arbitration. The understanding that what happens in arbitration, and the outcome, are private is seen by many as a key benefit of using the process.

But does an obligation on confidentiality actually exist? In reality, is there a uniform approach on the subject?

He provides insights into how parties can be required to maintain the private nature of arbitration and other procedures, and forced to maintain confidentiality.
